GENERAL INFORMATION

This document sets out the rules of the Privacy Policy for the Website www.jfkgroup.pl (hereinafter referred to as the „Website Service”). Words written with a capital letter have the meaning assigned to them in the terms and conditions of this internet service.

Personal data collected by the Website Administrator are processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, p. 1), hereinafter referred to as the GDPR.

The Website Administrator takes particular care to protect the privacy and information provided to them concerning Website Users. The Administrator uses appropriate technical, including programming and organisational, measures with due diligence to ensure the protection of processed data, in particular securing data against disclosure to unauthorised persons, loss, destruction, unauthorised modification, and processing in violation of applicable laws.

The recipients of the Services available on the website are not children under 16 years of age. The data controller does not intend to collect data concerning children under 16 years of age.

PURPOSE AND LEGAL GROUNDS FOR PROCESSING PERSONAL DATA

The data controller processes your personal data for the following purposes and scope:

In order to provide Services, i.e. browsing the website, searching for content or Services, we process personal data concerning your activity on the website, i.e. data concerning the content or Services you have browsed, data concerning your device's session, operating system, browser, location and unique ID, IP address;

To enable contact between the User and the Service Provider, we process personal data provided by you in the contact form, as well as data concerning your activity on the Service, i.e. data concerning the content you viewed, as well as data concerning your session, device and operating system, browser, location and unique ID. Providing certain data is a prerequisite for using specific Services and functionalities of the Service (mandatory data). Our system automatically marks mandatory data. The consequence of not providing this data is the inability for us to provide certain Services. Apart from data marked as mandatory, providing other personal data is voluntary;

For the purposes of statistics on the use of individual functionalities available on the Website, to facilitate the use of the Website, and to ensure the IT security of the Website, we process personal data concerning your activity on the Website and the amount of time spent on each subpage on the Website, your search history, location, IP address, device ID, data concerning your web browser and operating system;

for the establishment, investigation and enforcement of claims and defence against claims in court proceedings and other enforcement bodies, we may process your personal data necessary to prove the existence of a claim or arising from a legal requirement, court order or other legal procedure;

For the purpose of considering complaints, grievances, and requests, as well as responding to User queries, we process the personal data you provide in the contact form, complaints, grievances and requests, or for the purpose of responding to queries contained in another form, as well as data concerning the Services provided by us which are the cause of a complaint, grievance or request, and data contained in documents attached to complaints, grievances and requests;

For the purpose of marketing our Services and those of our partners, including remarketing, we process data concerning your activity on the Website, including activity that is recorded and stored via cookies. This specifically includes your activity history, ordered services, search history, clicks on the Website, login and registration dates, and your history and activity related to our communication with you. CATEGORIES OF RELEVANT PERSONAL DATA

The data controller processes the following categories of personal data:

  • contact details;
  • Website activity data;
  • complaints, grievances, and requests data;
  • marketing service data.

Voluntary provision of personal data

Providing the requested personal data is voluntary and is a condition for the provision of services by the Data Controller through the online service.

DATA PROCESSING TIME

Personal data will be processed for the period necessary to fulfil orders, services, marketing activities and other services performed for the User. Personal data will be deleted in the following cases:

when the data subject requests their erasure or withdraws their consent;

when the data subject takes no action for over 10 years (inactive contact);

upon receiving information that the stored data is outdated or inaccurate.

Some data, including your email address and full name, may be retained for a further 3 years for evidential purposes, and for the handling of claims, complaints, and liabilities related to the services provided by the Website – this data will not be used for marketing purposes.

Data concerning paid service orders, competitions and loyalty programmes will be stored for a period of 5 years from the date of order fulfilment.

Recipients of personal data

We pass your personal data on to the following categories of recipients:

  • state bodies, e.g. the prosecutor's office, the Police, the President of UODO, the President of UOKiK, if they contact us to do so,
  • to service providers that we use in the operation of the Website, e.g. for the purpose of making services available.

    Depending on the contractual agreements and circumstances, these entities act on our behalf or independently determine the purposes and methods of processing.

RIGHTS OF THE DATA SUBJECT

On the basis of GDPR you have the right to:

  • requests to access your personal data;
  • requests to rectify their personal data;
  • requests to have their personal data deleted;
  • requests to restrict the processing of personal data;
  • objecting to the processing of personal data;
  • requests for the transfer of personal data.

The data controller shall, without undue delay, and in any event within one month of receipt of the request, provide you with information on the action taken in response to your request. If necessary, the one-month period may be extended by two further months where necessary, taking into account the complexity or number of the requests.

In any case, the Data Controller shall inform you of such an extension within one month of receiving the request, stating the reasons for the delay.

RIGHT OF ACCESS TO PERSONAL DATA (ARTICLE 15 GDPR)

You have the right to obtain from the Data Controller information as to whether your personal data is being processed. If the Controller is processing your personal data, you have the right to:

  • access to personal data;
  • to obtain information about the purposes of processing, categories of personal data processed, recipients or categories of recipients of that data, the planned period of storage of your data or the criteria for determining that period, your rights under the GDPR and the right to lodge a complaint with a supervisory authority, the source of that data, automated decision-making, including profiling, and the safeguards used in connection with the transfer of that data outside the European Union;
  • to obtain a copy of your personal data.

RIGHT TO RECTIFICATION OF PERSONAL DATA (ARTICLE 16 GDPR)

If your personal data is incorrect, you have the right to request that the Administrator immediately rectify your personal data.

You also have the right to request the Administrator to supplement your personal data.

The right to erasure of personal data, the so-called “right to be forgotten” (Article 17 GDPR)

You have the right to request the Data Controller to erase your personal data when:

  • Your personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
  • you have withdrawn your specific consent, to the extent that personal data were processed based on your consent;
  • Your personal data has been processed unlawfully;
  • You have objected to the processing of your personal data for direct marketing purposes, including profiling, in so far as the processing of personal data is related to direct marketing.;
  • You have objected to the processing of your personal data in relation to processing necessary for the performance of a task carried out in the public interest or processing necessary for the purposes of the legitimate interests pursued by the controller or by a third party.

Despite a request to delete personal data being submitted, the Data Controller may continue to process your data for the purpose of establishing, pursuing, or defending legal claims, about which you will be informed.

RIGHT TO REQUEST RESTRICTION OF PROCESSING OF PERSONAL DATA (ART. 18 GDPR)

You have the right to request a restriction on the processing of your personal data when:

  • You question the accuracy of your personal data – the Data Controller will restrict the processing of your personal data for a period allowing the accuracy of that data to be verified;
  • when the processing of your data is unlawful, and instead of erasure of personal data you request the restriction of the processing of your personal data;
  • Your personal data are no longer necessary for the purposes of processing, but they are necessary for the establishment, exercise or defence of your legal claims;
  • when you objected to the processing of your personal data – until it is established whether the legitimate interests of the Data Controller override the grounds specified in your objection.

RIGHT TO OBJECT TO PROCESSING OF PERSONAL DATA (ART. 21 GDPR)

You have the right to object to the processing of your personal data, including profiling, at any time, in relation to:

processing necessary for the performance of a task carried out in the public interest or processing necessary for the purposes of the legitimate interests pursued by the data controller or by a third party.

RIGHT TO DATA PORTABILITY (ARTICLE 20 GDPR)

You have the right to receive your personal data from the Data Controller in a structured, commonly used, machine-readable format, and to transmit it to another Data Controller.

You can also request that the data controller send your personal data directly to another controller (provided this is technically feasible).

RIGHT TO WITHDRAW CONSENT

You can withdraw your consent to the processing of your personal data at any time.

Withdrawing consent for the processing of personal data does not affect the lawfulness of processing carried out on the basis of your consent before its withdrawal.

APPEAL TO THE SUPERVISORY BODY

If you believe that the processing of your personal data infringes GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, your place of work, or the place of the alleged infringement.

In Poland, the supervisory authority within the meaning of the GDPR is President of the Personal Data Protection Office.
